Terms and Conditions of Use

The website https://imagokit.com and the Imagokit platform are operated by Zemobile LLC, a company incorporated in the State of Delaware (United States), with registered office at 2810 North Church Street, Wilmington, DE 19802, United States (hereinafter "Imagokit", "the Company", "we" or "us").

By accessing or using the Services, you acknowledge that you have read, understood and agree to be bound by these Terms and by the complementary policies and legal texts published on the Website. If you do not accept them in full, you are not authorised to use the Services.

Identification of the responsible parties

  • Owner and operator (merchant of record): Zemobile LLC, 2810 North Church Street, Wilmington, DE 19802, United States. Responsible for the provision of the Services, the contractual relationship and charging through the payment provider.
  • Marketing and advertising: Elite Media Applications, S.L., Avda. Josep Tarradellas 38, 08029 Barcelona, Spain, Tax ID (NIF) B67444869. Responsibility for the Services, the contract and the charge lies exclusively with Zemobile LLC.

Important notice: nature of the service and warranty

Imagokit is a private, independent service. It is NOT an official body, does NOT issue or process official documents, and is NOT affiliated with, authorised by or endorsed by any government, consulate or document-issuing authority.

The service helps the User obtain a photograph that complies with the official requirements of a document, based on an image that the User provides, verified automatically. Final acceptance of the photograph rests solely with the authority to which it is submitted; Imagokit does not guarantee such acceptance, without prejudice to the conformity warranty and the free retake described in these Terms.

Definitions

  • Imagokit: web platform that generates and verifies photographs for official documents.
  • User: a natural person with legal capacity to enter into a contract through the Platform.
  • Services: the one-off purchase of photographs, the review and the subscription, and the Platform's other features.
  • Subscription: the "Imagokit Unlimited" plan with a free trial, described in the corresponding clause.
  • Platform / Website: web application accessible at https://imagokit.com.

First: Purpose and description of the service

The User selects the document and country, takes a photograph with their device or uploads an image, and the Platform crops it to the official size, adjusts the framing and background and automatically verifies, by means of an artificial-intelligence vision system, that the document's requirements are met (expression, glasses, background, framing, etc.). Once payment is complete, the User receives the verified digital photograph, ready to download, together with a 10Ă—15 cm print template, and may choose between the photo alone or a sheet with 2, 4, 6 or 9 copies.

Two optional additional services are offered on top of the one-off purchase: the compliance review (Fourth clause) and the "Imagokit Unlimited" subscription (Fifth clause).

Second: User accounts and access

Access to the account is password-free, by means of a single-use access link (magic link) sent to the User's email. It is possible to buy as a guest, without an account; the account is created when the subscription is accepted. The User is responsible for the security of their email and for the activity carried out through their account, and undertakes to provide truthful information and to ensure that the payment methods belong to them.

The User declares that they are of legal age. In the case of photographs of minors (for example, for a child's passport), the User declares that they are the parent or legal guardian or that they have sufficient authorisation to process the minor's image for this purpose.

Third: Prices, currencies, taxes and payment

The price of each service is shown on the Platform before the purchase is confirmed, in the User's active currency, with applicable taxes. The total amount is shown in full at the time of payment.

Payment is made through Stripe's embedded checkout, in an encrypted environment compliant with payment-industry security standards (PCI-DSS). Card details are collected and stored directly by Stripe; the Company does not store full card data, only the provider's identifiers or tokens. If the User pays in a currency other than that of their card, their bank may apply the corresponding exchange rate and fees.

Fourth: Photo review and free retake

For an additional charge, the User may purchase a compliance review of their photograph, carried out by an expert who checks that the document's requirements are met. If the photograph is rejected in that review, the User may retake it at no additional cost (free retake) by means of a single-use link.

Fifth: "Imagokit Unlimited" subscription and free trial

After the purchase, the User may activate the "Imagokit Unlimited" subscription, which includes a 7-day free trial. Activation requires a saved card. At the end of the trial, the subscription renews and the corresponding amount is charged automatically, on a recurring basis, unless the User cancels beforehand. The exact amount, currency and billing frequency are shown on the Platform before acceptance and remain associated with the subscription purchased.

Cancellation by the User: you may cancel at any time from your customer dashboard. The cancellation takes effect at the end of the period already billed; the User keeps access until that date and is not charged again.

Cancellation by the Company and refunds: the Company may suspend access immediately in the event of breach, fraud or abuse. A refund does not automatically cancel the subscription (for example, a duplicate charge is refunded without interrupting the service); if the User also wishes to cancel, they must do so from their dashboard.

Sixth: Delivery and access to digital content

Once payment is confirmed, the Company makes the verified photograph and the print template available to the User for immediate download, and sends confirmation to the email provided. Access to each order is protected by a high-entropy identifier and by temporary download links. The service consists of the supply of digital content and services; it does not involve the shipment of physical goods.

Seventh: Consumer rights, withdrawal and its waiver

The rights of withdrawal, cancellation and refund depend on the User's country of residence and the applicable consumer legislation.

  • EU/EEA consumers: as a general rule, they have 14 calendar days to withdraw, subject to the exception noted below for digital content.
  • Consumers in other countries: they have the rights granted to them by their local legislation.

Exception for digital content supplied immediately: since the photograph is delivered immediately, the User, in order to receive it instantly, expressly consents to the start of performance and acknowledges that, once the download or access has begun, they lose their right of withdrawal in respect of that content (Art. 103.m of Royal Legislative Decree 1/2007 and Directive 2011/83/EU). This consent and waiver are obtained expressly during the purchase process.

As regards the subscription, the User may cancel at any time from their dashboard, with the effects described in the Fifth clause. For EU consumers, the European Commission provides an online dispute-resolution platform (Art. 14.1 of Regulation (EU) 524/2013): https://ec.europa.eu/consumers/odr.

Eighth: Conformity warranty and limits

The verification seeks to ensure that the photograph meets the technical requirements of the selected document, and the review (when purchased) gives the right to a free retake if it is rejected. Nevertheless, final validity and acceptance depend exclusively on the issuing authority or body; the Company does not guarantee such acceptance, especially where the rejection is due to causes unrelated to the service (incomplete documentation, changes in appearance, requirements unrelated to the photograph or incorrect submission by the User).

Ninth: Acceptable use and User obligations

  • To use the Services lawfully and in accordance with these Terms.
  • To provide only images to which they hold the rights and the consent of the people appearing in them.
  • Not to use the service to impersonate identities, forge documents or for unlawful or fraudulent purposes.
  • To safeguard access to their email and account, and to provide truthful information.
  • Not to copy, resell or commercially exploit the Platform's software or content.

The User is solely responsible for the use of the photograph obtained and shall hold the Company harmless against claims arising from breach of these obligations or from the falsity of the data or images provided.

Tenth: Automated verification, disclaimer of warranties and limitation of liability

The automatic verification is carried out by artificial-intelligence vision systems, whereas the compliance review, when purchased, is carried out by an expert; both are provided "as is" within a standard of reasonable care, and may require the User to retake the photo if the image does not meet the minimum requirements. The User has the right to request human intervention in respect of the automatic verification in accordance with data-protection law (see Privacy Policy).

Limitation of liability: to the maximum extent permitted by law, the Company's total liability to the User shall be limited to the amount actually paid for the affected service. The Company shall not be liable for indirect damages, loss of profit or loss of opportunity. None of the above excludes liability that cannot be limited under the law, nor the consumer's non-waivable rights.

Eleventh: Intellectual property

The software, technology, design and content of the Platform (excluding the images provided by the User) are owned by the Company or its licensors. The User retains ownership of the photographs they provide and of those produced, and grants the Company a limited, non-exclusive and temporary licence to process them for the sole purpose of providing the service, in accordance with the Privacy Policy.

Twelfth: Data protection and biometric data

The processing of the User's personal data is governed by the Privacy Policy. The photograph of the face, processed to verify compliance with the requirements of an official document, constitutes special-category biometric data (Art. 9 GDPR) and is processed on the basis of the User's explicit consent and the performance of the contract. Photographs from orders without an active subscription are deleted after 30 days.

Thirteenth: Communications

The Company sends transactional communications necessary for the service (account access, delivery of the photo, review result, cancellation confirmation). Document-expiry reminders are scheduled voluntarily by the User and can be edited or deleted. The sending of commercial communications, where applicable, requires the User's prior consent and may be revoked at any time.

Fourteenth: Evidence and record-keeping

Save for manifest error, the records kept by the Company have evidential value in respect of the contracts entered into. Contractual and billing documentation is retained for the legally required periods in accordance with applicable commercial and tax law. The Company sends the proof of purchase to the email provided.

Fifteenth: Penalties and termination of the contract

The Company may terminate the contract as of right in the event of breach of these Terms or of fraudulent or abusive use; in the case of a serious breach, without notice. In the event of termination attributable to the User, the User may not claim any compensation or refund, without prejudice to any compensation that may be due to the Company. If the Company terminates for reasons not attributable to the User, it shall refund the amount of the service not provided.

Sixteenth: Amendments

The Company may amend these Terms and the service, in particular to adapt them to regulatory or technical changes, by publishing the current version with its update date, applicable to subsequent contracts.

Seventeenth: Assignment, entire agreement, severability and language

The User may not assign their contractual position without the Company's prior consent; the Company may assign it in the context of corporate transactions, guaranteeing the same level of protection. These Terms, together with the Legal Notice and the Privacy Policy, constitute the entire agreement between the Parties; if any provision is declared void, the remaining provisions shall remain valid. These Terms may be available in several languages; the version in the language in which the User entered into the contract shall apply and, in the event of any discrepancy, the English version shall prevail as the reference version.

Eighteenth: Applicable law and jurisdiction

The Services are provided by Zemobile LLC. These Terms are governed by Spanish law, without prejudice to the mandatory consumer-protection provisions of the User's country of residence, where the User may bring proceedings before the courts of their domicile. For EU residents, European and Spanish consumer legislation and the European Commission's online dispute-resolution platform apply.

Nineteenth: Withdrawal form

Where applicable, consumers may exercise their right of withdrawal before performance begins (download of or access to the digital content) by writing to hello@imagokit.com with: full name, date of contract, service purchased and an express statement of the wish to withdraw.

Private and independent service

Imagokit is a private photo-preparation service operated by Zemobile LLC. We prepare photographs to meet published size, format, background and framing requirements for passports, visas, identity documents and other applications. Imagokit does not issue, renew, process or sell official documents, does not create documents or identification, and is not involved in their official application, assessment or issuance. We are not affiliated with, authorised by or endorsed by any government, consulate or issuing authority. Users must submit their applications directly to the relevant official authority.
